Judge Sotomayor’s YouTube Moment: “The Court of Appeals is where Policy is Made.”

YouTube is constantly changing politics.  No doubt this YouTube clip will be posted on countless blogs and receive several thousand views before the day is over.

In it President Obama’s nominee for the Supreme Court, Judge Sonia Sotomayor slips up and says what she actually thinks.  She says that the court on which she currently serves “is where policy is made.”  Hmm, you may want to reread Article III of the Constitution.  I certainly do not find that in there.

White House Press Secretary Robert Gibbs tries to explain away this Sotomayor statement.

    The California Supreme Court just made policy regarding gay marriages.

    Article III does not forbid the courts from making policy.

    The fact is court decisions have made policy for decades.

    Look up the word precedent.

    California’s Supreme Court did not just make policy; the people made policy through a statewide vote. All the court did was uphold the people’s will.
